Terms & Conditions

  1. Definitions & Scope

These Terms and Conditions apply to all contracts for the supply of goods by Practical Plants Limited (“PPL”, “We”, “Us”) to business customers, including garden designers, landscape architects, and contractors (“The Customer”, “You”).

  1. Pricing & Quotes
  • 2.1 Price Alterations: PPL reserves the right to adjust prices at any time without prior notice due to market conditions, seasonal availability, or supply chain fluctuations.
  • 2.2 Currency Fluctuations: For items sourced outside of the United Kingdom, prices are subject to foreign exchange rate movements. PPL reserves the right to adjust final invoicing to reflect currency variations occurring between the date of the quotation and the date of order confirmation.
  • 2.3 Validity of Quotes: Quotations are valid for a maximum period of 28 days from the date of issue. Orders placed after this window will require a revised quote with updated pricing before confirmation.
  • 2.4 Taxes and Fees: All prices quoted are exclusive of Value Added Tax (VAT), delivery charges, and administrative fees, which will be added to the final invoice at the prevailing rate.
  1. Payment Terms
  • 3.1 Payment Windows: Unless otherwise agreed in writing by PPL, all orders must be paid in full via pro-forma invoice prior to dispatch. For customers with approved credit accounts, payment is strictly due within 30 days from the invoice date.
  • 3.2 Late Payments: PPL reserves the right to charge interest on overdue invoices at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998, calculated daily from the due date until full payment is received.
  1. Delivery, Inspection & Risk
  • 4.1 Transfer of Risk: Risk of damage to or loss of the plants passes to the Customer immediately upon delivery to the agreed site or upon collection from our holding nursery.
  • 4.2 Inspection Window: The Customer must inspect all plants thoroughly at the time of delivery. Any issues regarding damage, disease, shortfalls, or incorrect species must be reported to PPL in writing (via email with clear photographic evidence) within 24 hours of delivery.
  • 4.3 Sign-Off and Liability: Once a delivery note has been signed, or the 24-hour inspection window has closed without written notification, the goods are deemed accepted in perfect condition. PPL accepts no further liability and will not offer refunds, credits, or replacements thereafter.
  1. Live Goods Maintenance & Care
  • 5.1 Post-Delivery Care: Plants are living organisms that require immediate and appropriate care, including watering, sheltering, and correct planting. PPL accepts no liability for plant failure, dieback, or death resulting from improper handling, poor soil conditions, adverse weather, lack of irrigation, or negligent maintenance after delivery.
  • 5.2 Variations: The Customer acknowledges that plants are natural products; variations in shape, colour, height, and foliage density from sample images or catalogue descriptions are normal and do not constitute defects.
  1. Postponement & Cancellation
  • 6.1 Delayed Deliveries: If the Customer requests a delay or postponement of a scheduled delivery, PPL reserves the right to charge a daily maintenance and watering fee of 2.5% of the order value per week to cover nursery care costs.
  • 6.2 Cancellation: Orders cancelled by the Customer within 14 days of the scheduled delivery date will be subject to a cancellation fee of 100% of the total order value.
